Class Action - Comfort Access Locking

Received a letter today and thought I'd share this with you all even though I don't own a E70...

This is addressed to those that:

Ever owned or leased a October 1st, 2006 through June 30th 2013 (production date) X5 E70 with optional Comfort Access System.

Case - Myers v. BMW of North America

You may be entitled to benefits under this proposed class action settlement.

Attached are some items of the letter that I received... you can also call 877-310-3707 or visit www.ComfortAccessSettlement.com

The Interesting thing is...that I had this problem on my F15 as well... wonder if I'll get one of these again... for my current vehicle...

I got the letter as well. Still have my E70 but have never had an issue with Comfort Access.

Received also, no issues unless I istalll my rear dashcam too close. But that is not BMWs fault.

Its a scam. For every sucker they recruit, the lawyers get a few thousand grands and the sucker gets an oil change coupon

Class Action - Comfort Access Locking

Wow that's crazy. I haven't received anything yet but had an issue a few months ago. Wife had the keys in the diaper bag and placed it on the front seat while loading up the kids. Soon as she closed the kids doors, the truck locked which didn't make sense. She called me frantic while her sister was on the phone with 911. Of course I told her to smash a window, but she was unable to. Luckily my 4 year old was able to loosen his car seat and open the door from the inside before any help arrived. Scared the shit out of me. Love the truck but wanted to burn it to the ground that day.

Yup we had a similar situation.luckily I had an extra key at home. Should unlock if key detected inside.

Yup same here, I had to replace wifey lexus tires and left the keys in the front seat, once I loaded the whole 4 tires in the trunk the X5 locked by itself. I was like what da? Called wifey to bring other key and now she was screamin why, what da heck i left the key inside X5? I was like, da ? I didnt expect the truck locked by itself

I got 2 in the mail, probably because I owned 2 X5s, 11 X5 and 13 X5M, I didn't have comfort access in my 11 and do have it in 13, currently the comfort access doesn't work after I changed my dash last year, I just didn't have time to investigate why but I don't think this is related to issue in the letter.

Where’s the class action about these door handles giving out and draining the battery and not working?

The replacement cost for each is 250/piece last I checked and I’ve had every single one of my doors fail ...

I got the same letter. I spoke with a lawyer that specializes in class actions. Basically the lawyers have a few people in the class, but not enough to make money on. So they are fishing for more people that can better justify going through with the lawsuit. If they don't get enough responses, or the damages are not sufficient, then they will not proceed.

It hasn't happened to me yet, so I just tossed the letter.

We experienced this last August. My wife backed out of the driveway and realized she had forgotten something so she pulled back in and when she got out she heard it beep like she had locked it. One key was in the passenger seat in her purse and we thought the other key was in the diaper bag behind the passenger seat. With our three month old son in the vehicle I didn’t have much of an option. A quick search turned up that it’s fairly common and the quickest/cheapest way out was to shatter a window so.....I took a hammer to the passenger front window. I recieved two of these letters last week but I’ve just never been a big fan of seeking compensation. The new glass and all new door panel clips was just a bit over $180 so for me it’s just not really worth the trouble. It’s just another “quirk” that comes with this platform that we’ve learned and we will operate it with that in mind going forward. Kinda like replacing plastic CCV lines, oil pan gaskets, valve cover gaskets......etc!!! Lol
