Tailgate back window rubbing on the passenger side and front fenders miss-alignment

Is it common for a 2013 35i with 86K miles to have the back window (tailgate) rubbing on the upper back site panel (see attached picture)? Mind the excessive pollen accumulation.

I do hear from time to time a rattle coming from the back, when I hit bumps or pothole (Montreal's charm).

Also, is that generation had gap panel issues with age?

The car was advertised "accident free".

I would say no, it should not be rubbing. Very likely the tailgate and rear hatch needs to be adjusted.

I followed the procedure in this video to adjust my gate and hatch:
