Check dv for your state as it can vary. His insurance company may want to use aftermarket parts and in most cases if your car is not current model year with 12k miles or less, they can do that. You can argue for oem but if they stick to their guns, your stuck and they will give you the options of paying the difference or filing your own insurance and pushing for oem parts and have them subro his insurance but sadly there is a section in your binder thet will specifiy thier use of aftermarket and even used parts that no one ever looks at but agrees to by accepting the policy.
