X-5 Battery not covered by CPO or Maintenance Warranty

I know I was told that the warranty would cover battery replacement. I feel like I am getting ripped off by purchasing a replacement battery and paying for the cost of labor from the dealer. However, I am told that the warranty will not cover a battery that is not "factory" from the dealer. My X-5 is an 05' with 51,000 miles. Any thoughts?
