I received a call from my dealer as well telling me the same thing. Xoutpost has posted the option sheets for the 2010 X5.

Garage List
Just spoke with my dealer and she said to get the credit for 2010 you have to have a production # for an '10 model by Aug 31 2009. Sounds like if you want the credit you need to go ahead and lock in an order. I got a Nov build.

Is this effectively a rebate from BMW?

Yes - So, go to the dealer, build/order the vehicle exactly the way you want it, agree on price, then apply the $4,500 rebate, sign the paperwork, and it will show up in October or November. I just did this with a great dealer in NYC at INVOICE plus the rebate for about $8,500 off sticker plus the $1,800 tax credit from Obama.
