Doesn't help here but I believe the period is only 3 days in NY.

Just spoke to attorney and they said it does apply and i do have a case here. the fact that i failed emissions and the car has been in the shop longer than ive owned it means i have a case and a few options.

Im also going to wait until i get it back and see how it drives if it still gives me issues than I'm going to have to take a case for it.
