-black interior
-under 50k miles
-no exterior color preference
-no more than 100 miles from philly
-no accidents
-minimal mods to none at all

whats interesting about it? his car is out of my budget simple as that, most may not even consider to sell for $40k.
however if theres a chance of finding one, why not ask ?

Your best option will be at auction, when I got my car ( X5 3.5 with 40K for $35,000) I saw a 2012 X5M with 47k that went for $40,500 (now Im thinking I should have bought that one.

Didn't you have a an X5 M sport before? If so, I can sell you my complete engine, turbos and transmission so you can swap for significantly less than $40k!

Not much ...

Anything with fewer miles and higher rating is 10 grand more ... at auction! Figure 15 grand more at the retail level.

That car was bought at auction for:

"2011 BMW X5M 8G 4CUV A PS PB AC PN AWD 48,355 SPACE GR $41,800"

Cars.com does not show current status, but it is SOLD. Original asking price was $48K+, don't know what it sold for, but it was not $40K ...

^ That dealer doesn't negotiate either. They may take a max of $1K off, but that's also what they charge for dealer fees anyway, so you're still paying the same price. Still make a $5K-$7K profit on each car without doing anything to it other than a car wash.
