EGR Coolant Thermostat covered by Federal Emissions Warranty (8yr/80k)?

Recently my CEL came on and it's the infamous P2457 egr coolant. Also, the engine temp is registering at 69-71C instead of the usual 79-80C. I'm assuming it's the thermostat. If it is or a cracked egr coolant. Would the Federal Emissions Warranty (8yr/80k) cover it?

unlikely. If you're in a CARB state, or if the car was originally registered in a CARB state, thermostats and exhaust cooler for EGR on the X5 35ds have 7yr/70K mile coverage (this is from my 2012 X5's warranty booklet).

CARB states:
Arizona, California, Connecticut, Maine,
Maryland, Massachusetts, New Jersey, Oregon,
Pennsylvania, Rhode Island, Vermont or
Washington
