i stated this some time ago here: http://www.xbimmers.com/forums/showt...php?p=19460354 and my aggravation lies with BMW's poor ability to comfort current drivers/owners/lessees or anything in-between. i know a few dealers in the area wholesale'd their X5M to independent dealers because they do not have to answer to BMWNA. two weeks ago there were a few X5M available CPO at certain dealers. this week they are available at independent dealers within the same area. for anywhere between $3500-5000 less than the original selling dealer.

the question is how long do you have to wait for someone who is looking to buy an e70 with open recall in the private market and willing to pay a premium for it on top of it all and not get cpo on top of it. the Q7 tdi crowd thought the same and felt their vehicles will go up in value due to the lack of ability to attain one and prices have dropped not gone up.

Replacement air bags were possibly the same faulty Takata units they used at the factory. Remember a remedy is still being developed.

There are several on CarMax' website. You can also get their MaxCare warranty for 6 years from date of used car purchase and up to 100K or 125K total miles; $100 deductible 100K miles plan is ~$4K.

Just an FYI: Transactions are taking place in one form or another. My brother just received his title from BMW from a recently-expired lease on his '13 X5. The lease expired just after the recall date. He had requested, in a letter, that the title be sent to him since he sent them payment to purchase the car.

I just got rid of my x5m a day ago and most dealers I spoke to (BMW) were offering thousands less saying they had a whole bunch of cars sitting on the lot that are part of the "do not sell". They said there is still no remedy to the issue and it may not be until mid summer because more and more manufacturers are having the issue .

Non BMW dealers are still selling them without a problem, friend just bought one from a used premium car dealer, so I guess it's just BMW dealers that can't sell. Other non BMW dealers will still sell and buy them without issue.

Apparently, BMW will sell them, because they just sold my brother's leased car to him.

Call any BMW dealer and see if you can buy any of the listed models on the recall list. I called dealers from NY to VA when I was trading mine in a few days ago. They will take them on trade but can't sell them. this article from 3 days ago also mentions the 840k model stop sale and how BMW NA is going to help the dealers out because of it.

I haven't spoken to dealership retail transactions. Again, transactions must be taking place in one form or another since title from BMW was transferred to a consumer post recall date.

I think because there is no airbag recall in Canada for E70 yet.

I think there is a lot of speculation and perhaps over reaction going on in here. My 06 Tundra is affected right now too. It's not just limited to our vehicles. I got a "remedy notice" a couple days ago to have my passenger side front airbag inflator module replaced. Once the airbag modules become available, the dealer replaces them and all is well.

My dealer said it was a recall, however, no parts available and on back order. No indication on wait time.

As far as values, there's not another truck out there that can touch this one. It's the fastest, period. For $40-$45K you can't buy a TT ML63, which leaves the SRT8? I respect the power for sure but it's not a BMW.

These ain't going up in value but they should remain strong. I say while gas is $3/gallon drive them like they're stolen!

We can't sell them cars to dealers (and of course we shouldn't to sell privately with possibly a huge loss since buyers should know these are under recall) and can't get BMW to fix it...

Am I the only one really frustrated by this "trap" that we're in? Has anyone received any sort of remedy?

Imagine being on the other side of this.
I've been looking at getting a newer car to replace my old Jeep GC and want a E70 X5 35D
My current 435 has had enough issues that I don't want to buy anything other than a CPO car.

If my wife's GC craps out my option is buy from a dealer other than BMW and get a car with open recall (and it won't be CPO) - Carmax has been dinged for not telling people about recalls so I think they do now, but as an independent company with no obligation to BMW they have no problem buying and selling used cars with open recalls.
I might be able to find a CPO car from a private individual

Has anyone actually determined that the value of a car with an open recall is less at any dealership?
My guess is that it really didn't make a difference. Non BMW dealers don't care because the car can't be fixed by them so they just sell it like any other car (maybe they disclose the fact that it will get a new airbag like several million other cars out there)
BMW dealers are the only ones who are restricted from selling a BMW with an airbag recall - if you don't get the same trade in offer from them as you would from the Audi or MB dealership down the road they stand to loose your business so they'll be smart to offer you the same as they would if it wasn't a recall.

Test the market and see if your car is worth any less than you would have expected. I haven't seen any big change in the price I would expect to pay for one and I have kind of been paying attention for more than 6 months.

If you want to sell yours to a private individual the right thing to do is to disclose the open recall (on yours and every other E70 the buyer is looking at). Since you have no way to fix it yours is the same as every other E70 and you won't be at any disadvantage (don't let the buyer try to make it his advantage, if he wants an X5 he should know it's true or be told it's true with all of them)

The thing that sucks for me is that there are basically no CPO cars available and it isn't clear if BMW will modify there existing CPO policies so that some of the cars that are currently aging in the back lots will be able to become CPO. My other worry is what are the potential issues to be brought about by having my next car spend 6 to 9 months parked.
All those lease returns are owned by BMW so the dealers holding onto them for BMW have very little reason to do anything special - if something gums up while it is sitting there, it is just more service work for the dealer that will be paid for by BMW corporate.
