Since it's a used car, the dealership has very little obligation to you, other than goodwill and servicing based on CPO coverage. If they told you certain things would be covered, you should have gotten it in writing. You should have gotten the car inspected by an indy mechanic and obtained the full service history before purchasing it. They were under no obligation to tell you it was previously a loaner. Relying on a CPO inspection is like the wolves guarding the hen house. I suggest taking whatever you can from them, servicing the heck out of it (as much as CPO will cover), and requesting a credit toward another CPO vehicle, but this time, going into it eyes wide open. I'd sell it and pickup the one in the for sale section for $25k with two years warranty left. Sounds like you got yourself a problem child and might not be worth dealing with the potential issues.

unfortunately, join the club. i have a 2010 with a million issues as well! take whatever bmw na will give you. buy a code reader and learn to work on it yourself. according to bmw, there is nothing wrong with your car! i too, do not like the way the new cars drive either.

You should definitely be seeking a lawyers advice, instead of asking a public forum's opinion of truth telling, IF you think you've been scammed! My opinion only, though.

Unless they made any material misrepresentations (fraud), there's no duty to disclose. They didn't lie to you by failing to give you paperwork which you should have secured prior to purchase, unless you made that documentation contingent, in writing, prior to signing the purchase contract, which you did not. I'm sorry to say, but the time to be pressing this issue is not a year-and-a-half later. Used cars are normally purchased "as is", which means, with all faults. There's some legal advice.

The problem is that you are 1.5 years into ownership and just now bringing this to attention. Even then it sounds like BMW NA is trying to work with you by giving you an extra year of warranty or credit towards a trade in.

If you like the X5 so much why consider other options? If I were you I'd look at finding another CPO X5 35d at a dealership around your area and take advantage of their offer. Otherwise if you feel the need to battle this out with BMW any further have a lawyer review your case.

Yeah I think your biggest hurdle is that you're 18K miles and 1.5 years in. If it was a relatively new purchase and non disclosure issues were apparent you would have an argument that people would listen to.

Like everyone else said, speak to an attorney that deals with these issues. Be polite and courteous with BMW but hold your ground. Good luck, I've heard of people being bought back at original price, and I've even heard of people getting the current model year upgrade at no cost for non disclosure related problems. It's a headache big dealers do not want to deal with.
