2010 is the first year and I believe there are some difference like soft closing door is standard on 2011 (not sure if it's an option for 2010)

I'm from NY I own a 2011 x5m that's going to be traded in a week or two as I have already made the deal with the GTR (awaiting for credit approval) Perhaps this might help you out since I never intended to sell private party. Guess it's better for you to save the money than dealership to make money on the car.
it's 2011 white with back interior fully loaded (extended leather, head up display, massage chairs etc etc)
The car only have 9000 miles (just hit 9000 today). I'm willing to let it go for about 72k (maybe 72.5, not sure of the exact number) (basically same as trade in plus taxes i would save). I can verify this w/ the written deal i get from the gtr dealership. I dont plan on make a penny on this as it's going to be traded anyway. The car is in perfect shape and it has the non run flat all season tires that I put on about 3,000 miles ago.
