If you are at all mechanically inclined (and it sounds like you may be), one thing that could be helpful in the interim is to take a look underneath every few thousand miles and see if there is any evidence of the shaft starting to fail. How to make such an inspection has been published by BMWUSA and discussed in other threads (not sure if it was here or one of the X5 forums).

Seems to be a very easy inspection, other than having to get under the car.

Not suggesting this should be your responsibility, but as long as BMW is going to simply allow owners to continue with these driveshafts until they fly apart, it could be a prudent thing to do. Would hate to see you have to experience what we did.
