The 35d and 40d are the exact same engine. One has stricter emissions requirements and less tuning, (35D) (for US standards.)the 40d does not have the restrictive exhaust and urea requirements and the higher tune. But the exact same block and internals.
And the N57D30OL (35d) is STILL used here in Europe. The N57D30TOP (40d) is used in the X6/X5 and 740d. 5 series and others use this (35d) engine.
