Correct.
Selling a car, regardless of the venue or the buyer, changes the title and along with it implied liability. BMW does not want liability for a car with a known open recall.
Other car brands are starting to do the same, including retailers like Carmax. Their CEO said the other day on MSNBC that about 10% to 12% of their inventory is currently effected by this airbag recall ...
