Just to add to this thread, apparently our X5 does the same thing. I thought it was just a fluke, but now I'll have to test it out. I'll also compare to my '11 M3 and see how it behaves. Both vehicles have Comfort Access... Will report back.
With two small children, this is disconcerting..
